David Wolfe Australia (davidwolfe.com.au) is operated by Wattlegrove Services Pty Ltd (ABN 25 066 064 293), trading as Wild FireHouse ("we", "us", "our"). We run this store and website, including all related information, content, features, tools, products and services (the "Services"). Our store is powered by Shopify.
This Privacy Policy explains how we collect, hold, use and disclose your personal information when you visit, use or buy from the Services. We are committed to handling personal information in line with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).
1. Personal Information We Collect
Depending on how you interact with the Services, we may collect:
- Contact details: name, billing and shipping address, phone number and email address.
- Payment information: transaction details and payment confirmation. Card details are entered on our payment providers' secure checkout and are not stored by us.
- Account information: username, password, preferences and settings.
- Transaction information: items you view, add to your cart, buy, return, exchange or cancel.
- Communications: messages you send us by email, contact forms or our chat assistant.
- Device and usage information: your device, browser, IP address and how you navigate the Services.
Health information
We don't ask for health information. If you choose to tell us about a health condition, medication, pregnancy or similar (for example, in an email or a chat message), that is "sensitive information" under the Privacy Act. By sending it, you consent to us using it only to respond to your enquiry. We won't use it for marketing and won't disclose it unless the law requires us to.
Staying anonymous
You can browse the website and ask general questions without identifying yourself. We do need your name, address and contact details to process and deliver an order.
2. How We Collect Personal Information
- Directly from you when you place an order, create an account, sign up to our emails, enter a promotion or contact us.
- Automatically through cookies and similar technologies when you use the Services (see section 5).
- From third parties such as Shopify, payment providers, delivery partners and marketing platforms.
3. How We Use Your Personal Information
We use your personal information to:
- process payments, fulfil and deliver orders, manage your account and handle returns and refunds;
- answer your questions and provide customer support;
- send you marketing, where you have agreed to receive it (see section 4);
- improve and personalise the Services;
- detect and prevent fraud and keep our checkout secure; and
- meet our legal obligations, including tax and consumer law.
We only use your information for the purpose we collected it for, a related purpose you would reasonably expect, or another purpose you have agreed to or that the law allows.
4. Marketing Emails and Texts
We only send marketing emails or SMS when you have agreed to receive them, in line with the Spam Act 2003 (Cth). Every marketing message identifies us and includes a simple way to unsubscribe. You can opt out at any time by using the unsubscribe link, replying STOP to an SMS or contacting us. We will still send you messages about your orders, such as confirmations and tracking details.
5. Cookies and Tracking
We and our partners use cookies and similar technologies to run the store (for example, to keep items in your cart), to understand how the Services are used and to show you relevant advertising. You can manage non-essential cookies through our cookie banner and your browser settings. Blocking some cookies may stop parts of the store from working properly.
6. AI Customer Assistance and Automated Decisions
We may offer an automated artificial intelligence ("AI") chat and shopping assistant to help answer product questions, find products and help with order enquiries.
- What the assistant uses: your chat messages, session data and, where needed, your account or order details, so it can answer you and so we can improve the accuracy of its answers.
- Accuracy: the assistant generates answers automatically and may sometimes give incomplete, inaccurate or out-of-date information. Always check product availability, ingredients, pricing and delivery details against the product page and our store policies.
- Not health advice: the assistant is not a doctor or health professional, and nothing it says is medical advice, a diagnosis or a treatment plan. Speak with a qualified health professional before starting a new supplement, cleanse or wellness programme, especially if you are pregnant, breastfeeding, taking medication or managing a health condition.
- Please don't share sensitive details in chat unless you need to. If you do, section 1 ("Health information") applies.
Automated decisions
The AI assistant does not make decisions about you. Our checkout uses automated fraud screening (provided by Shopify and our payment providers), which looks at order, payment, device and address information to assess the risk that an order is fraudulent. Orders flagged as high risk may be held [CONFIRM: "and reviewed by a member of our team before they are cancelled" or "or cancelled automatically"]. If you think your order was wrongly held or cancelled, contact us and we will review it.
7. Who We Disclose Personal Information To
We may disclose your personal information to:
- Shopify, and service providers who work for us, such as payment processors, IT and cloud storage providers, warehouse and fulfilment partners, and delivery companies;
- marketing and advertising partners, where you have consented or where you can opt out;
- professional advisers such as accountants and lawyers;
- a buyer or successor if our business is sold or restructured; and
- government agencies or law enforcement, where the law requires or allows it.
We do not sell your personal information.
8. Overseas Disclosure
Some of our service providers store or process information outside Australia. Your personal information is likely to be disclosed to recipients in [CONFIRM: the United States, Canada, Ireland and the United Kingdom], mainly because that is where Shopify, our payment providers and our email and advertising platforms hold data. We take reasonable steps to make sure these providers handle your information in a way that is consistent with the Australian Privacy Principles.
9. Security and Data Retention
We take reasonable steps to protect your personal information from misuse, interference, loss and unauthorised access, including encrypted checkout and restricted access to customer data. No system is completely secure, so we cannot guarantee that your information will never be accessed without permission.
We keep personal information only for as long as we need it:
- Order and payment records: up to 7 years, to meet our tax and record-keeping obligations.
- Marketing data: until you unsubscribe or ask us to delete it.
- Account data: while your account is active, or as needed to resolve disputes and enforce our policies.
When we no longer need information, we take reasonable steps to destroy or de-identify it.
If a data breach is likely to cause you serious harm, we will notify you and the Office of the Australian Information Commissioner (OAIC) as required by the Notifiable Data Breaches scheme.
10. Accessing and Correcting Your Information
You can ask for access to the personal information we hold about you, or ask us to correct it if it is inaccurate, out of date or incomplete. You can also ask us to delete your account or stop sending you marketing. Contact us using the details in section 13. We will respond within 30 days. There is no charge to make a request. If we refuse a request, we will explain why in writing, unless it would be unreasonable to do so.
11. Complaints
If you have a concern about how we have handled your personal information, please contact us first so we can try to fix it. We will acknowledge your complaint promptly and aim to respond within 30 days.
If you are not satisfied with our response, you can complain to the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au or on 1300 363 992.
12. Changes to This Policy
We may update this Privacy Policy from time to time. The latest version will always be on this page, with the date it was last updated.
